Litigation is more expensive and frustrating than it needs to be.
Too many clients have had the same experience in litigation. Outside counsel at first give optimistic assessments of the client's case. Over time the litigation budget balloons beyond initial estimates. Everything takes longer than expected. Unanticipated problems arise -- the judge makes a "wrong" ruling, a key witness performs poorly in deposition. As trial approaches risks that once seemed manageable loom larger, and outside counsel's optimism wanes. The case settles, often on terms less favorable than the client expected at the beginning of the process.
Why?
Many times the answer is that outside counsel’s initial predictions about the timeframe, cost and likely outcome of the case were unrealistic. Outside counsel do not intentionally underestimate the cost of litigation or overstate the client's prospects, but there are undeniable pressures on counsel to be optimistic when trying to win a client's business. Clients want a zealous advocate in litigation, and every rainmaker knows this instinctively.

We are guided by the following advice that Abraham Lincoln shared with a gathering of fellow attorneys over 150 years ago:
"Discourage litigation. Persuade your neighbors to compromise whenever you can. Point out to them how the nominal winner is often a real loser -- in fees, expenses, and waste of time. As a peacemaker, the lawyer has a superior opportunity of being a good man. There will still be business enough."
Although we are guided by these principles, we also recognize, as Lincoln did, that not every dispute can be settled, and that there are circumstances in which a trial or arbitration is the only way to resolve the matter. When a dispute cannot be settled, we are committed to providing outstanding litigation services to our clients.
We believe that every aspect of litigation is critical and that continuity is necessary to properly litigate a case. For those reasons, we intentionally limit the number of matters we take on so that we can assure that the same attorneys will handle the matter from start to finish.
